The Supreme Court of the United States recently ruled that regulations differentiating between online direct sales by out-of-state wineries and in-state wineries were discriminatory against interstate commerce. The states of Michigan and New York allowed in-state wineries to ship directly to consumers while requiring out-of-state wineries to go through a wholesaler and retailer. The court found that these regulations deprived citizens of their right to access other states' markets on equal terms, were not authorized by the Twenty-First Amendment of the U.S. Constitution, and did not advance a legitimate local purpose that could not be served by reasonable alternative regimes.
