U.S. Court Bans LimeWire Service for Infringement of Copyright

In the decision of Arista Records LLC et al v Lime Group et al, U.S. District Court delivered in October, 2010, a U.S. federal judge found LimeWire, one of the world’s biggest music-sharing service, liable for copyright infringement and ordered it to “disable the searching, downloading, uploading, file trading and/or file distribution functionality, and/or all functionality of the software.”

This decision followed a unanimous 2005 U.S. Supreme Court judgement against file-sharing service Grokster Ltd.  That ruling states that companies could be sued for copyright infringement if they distributed services designed to be used for that purpose, even if the devices could also be used lawfully.

A trial following this decision has been scheduled in January to determine the damages the record companies have allegedly suffered.
