The European Court of Justice in Luxembourg has prohibited Italy from using criminal law to prosecute bookmakers based in other European countries. Italy had prosecuted three executives from Stanleybet International, a British gambling company, who operated local gambling shops where customers could place bets with Stanley’s home office in Liverpool, U.K.
The court’s decision, however, left some uncertainties. The ruling applies to sports betting, but it stopped “short of explicitly endorsing the idea that holders of a betting license in one EU country should be able to operate without borders”.
