Prior to October 2007, Canadians buying tickets by phone or email from Ticketmaster were required to agree to share their personal information, including their email address, with all event organizers and promoters including venue owners, participating teams, artists’ representatives, fan clubs, promoters and leagues. The Alberta Privacy Commission found that Ticketmaster was collecting personal information for the purpose of transferring them to entertainment and sports organizers, who in turn used them for marketing. The Commission found this to be unreasonable and ruled that Ticketmaster’s ticket-buying service deprived customers the opportunity of making informed decisions respecting the consent they gave as it did not give them reasonable opportunity to decline or object to the use or disclosure of their personal information to third parties. Ticketmaster has since responded by changing its website and telephone ticket-buying requirements in compliance with the Commission’s ruling.
