Research In Motion’s long running battle with patent holding company NTP continues to move on parallel fronts. RIM is appealing an infringement verdict to the U.S. Supreme Court and made a bid to halt lower court proceedings on the verdict pending the appeal. Chief Justice John Roberts of the U.S. Supreme Court recently rejected the emergency request. However, the denial is unrelated to the Supreme Court’s decision on whether to hear RIM’s formal appeal of the decision from the Court of Appeal for the Federal Circuit.
In addition to the judicial proceedings, the five patents held to be infringed in the suit are before the U.S. Patent and Trademark Office in re-examination proceedings. The USPTO recently issued papers rejecting each of the patents. NTP has opportunities to respond to the rejections.
The appellate decision upheld much of the District Court verdict but directed the lower court to review certain errors during the trial. It is also expected that the lower court will review RIM’s bid to enforce a settlement agreement reached earlier this year but which NTP denies was finalized.
