Oracle and SAP in Major Corporate Espionage Lawsuit

Oracle Corporation, the major database and enterprise software developer, recently launched a lawsuit against European software giant, SAP AG, and one of its subsidiaries. Alleging “corporate theft on a grand scale”, the lawsuit indicates an intention to name individuals personally in respect of the wrongful activities alleged when their identities can be ascertained.

The suit, launched in Northern California, alleges that SAP used access codes belonging to Oracle customers to access support materials. It is alleged that the IP address for all of these instances of unauthorized access was traced to a SAP subsidiary office in Texas. All of the customers whose access codes were allegedly used were, or became, SAP customers (including Honeywell and Merck). The claim sets out Oracle’s business strategy and the fact that its recent acquisition of PeopleSoft and JDEdwards was aimed at SAP’s market share. SAP’s subsidiary was to counter this threat by providing legacy support for Oracle customers wishing to switch to SAP.
