Online Pharmacy Takes Federal Government to Court

CanadaRX, an online pharmacy, is taking the federal government to court to prevent an inspection by Health Canada. Most online pharmacies pay Canadian doctors to sign prescriptions for American customers in order to comply with regulations governing accredited pharmacies. However, CanadaRX is not an accredited pharmacy and has been selling drugs to American customers, either directly, or through their doctor or pharmacists. CanadaRX alleges that Canadian export laws make CanadaRX immune from any provisions of the Food and Drugs Act that may limit the sale of Canadian drugs to drugs prescribed by Canadian licensed health-care professionals.

The outcome of this case could determine whether online pharmacies are required to obtain a prescription from a Canadian doctor before selling drugs across the border.
