Online Criticism of Law Related Advice Site Prompts Suit

AdviceScene, a website providing connections between the public and legal professionals who provide free legal information and advice, has sued the operators of another website, lawbuzz.ca, as well as its contributors, for critical comments posted to the Lawbuzz forum.

Site operator Law Buzz Canada Ltd. settled out of court with an apology and an agreement to identify four of its registered members. The site has since been closed. However, an Aurora, Ontario, personal injury lawyer and the former President of the Ontario Trial Lawyers Association, Russell Howe, was named and faces additional litigation. Though critical of the site for naming names, Howe notes his activities were not exactly anonymous as he often signed his first name, gave his email address in postings or referenced cases on which he had worked. AdviceScene claims that its model is based on the participation of experienced lawyers, like the professionals criticising the site, and that the unfair criticism hurt its business. Howe denies his comments were directed at AdviceScene and the occasion of any damages.
