New Zealand Restaurant Fined for Out-of-Date Menu Information on its Website

In Waitakere, New Zealand, the District Court ordered Tony's Vineyard Restaurant to pay a $NZ3000 fine, as well as court costs, for advertising on its website a menu with out-of date prices and dishes. The owner of the restaurant had pled guilty to charges of breaching the Fair Trading Act after a Commerce Commission investigation found that many of the meals advertised on the website were either unavailable or not available at the listed prices. For some menu items, the website prices were 17 to 36 percent cheaper than the actual restaurant prices. Both the Commission and the District Court Judge determined that the misrepresentations were not inadvertent and that the restaurant owner was aware of them. During sentencing, the District Court judge stated that the New Zealand Parliament had taken a strict approach to misrepresentation and had thereby guided the Court with respect to the appropriate sentencing measures.
