New York Applies Telephone Regulation to VoIP

On May 21, 2004, the New York State Public Service Commission issued its ruling that Vonage Holdings Corporation, which provides telephone-like services using voice over Internet Protocol (VoIP), is subject to regulation by the Commission as a telephone corporation. The Commission's ruling is based on its finding that Vonage owns and manages telecommunications equipment used to connect its customers to customers of other telephone corporations via their public networks. The extent of the actual regulatory regime that will apply to VoIP has not been determined, although it is contemplated that the regime will be minimized so as not to interfere with the rapid, widespread deployment of VoIP technology, while at the same time ensuring the reliability of telecommunications networks.
