State Farm Mutual Automobile Insurance Co. is challenging Canada’s federal privacy law regime with a constitutionality claim in the Federal Court of Canada. State Farm argues that the law is not within the federal government’s trade and commerce power. If successful, the law could be declared invalid, affecting thousands of businesses.
The suit was brought in response to a disclosure order by the Privacy Commissioner of Canada. An injured party in an insurance claim demanded that State Farm identify to him anyone to whom State Farm had disclosed his personal information. The company refused and a complaint was filed with the Commissioner.
