Indiana Court of Appeals Protects Students MySpace Comments as Free Speech

The Indiana Court of Appeals has overturned a student’s juvenile delinquency conviction arising from derogatory comments she made about the school’s principal on a MySpace.com webpage. The posting at issue was profane and insulting but also criticized the school’s policy on decorative body piercing. At trial, the student was found to be delinquent because, if an adult, her postings would have constituted harassment under Indiana’s Criminal Code. The Court of Appeals overturned the finding of juvenile delinquency by ruling that the posting was protected political speech under the Indiana Constitution.
