Directive 2002/58/EC Concerning the Processing of Personal Data and the Protection of Privacy in the Electronic Communications Sector was to be incorporated into the national laws of member states by October 31, 2003. However, the European Commission has recently warned that eight countries have failed to take the necessary measures. The Commission has given a warning to France, Belgium, Luxembourg, Germany, Finland, Greece, the Netherlands and Portugal. If they fail to respond within two months, the result will be legal action before the European Court of Justice in Luxembourg. The Directive sets rules for protecting privacy and personal data in mobile and fixed communications, including the Internet, and bans unsolicited email (spam) throughout the E.U. It also sets rules for the use of cookies on personal computers.
