A recent report reveals that the Electronic Software Association (“ESA”), representing the business and public affairs interests of the U.S. video game industry, is preparing to sue the governor of Michigan in an attempt to overturn Senate Bill 0416. The bill seeks to limit sales of violent video games to minors in Michigan, and is scheduled to come into effect on December 1, 2005.
Other state legislatures, including those in California and Illinois, have introduced similar bills. The Michigan Governor’s Office believes that there is a compelling state interest to protect children from the effects of such games. However, the ESA contends that Michigan’s law is too vague, likely resulting in the infringement of First Amendment rights and confusion among those affected
