The European Commission has released an information and consultation document on the treatment of voice over Internet protocol (VoIP) under the EU regulatory framework. The document seeks to clarify the extent to which various VoIP market offerings are subject to the rights and obligations of a provider of publicly available telephone services, in addition to being regulated as an electronic communication service. The document considers the appropriate application of various Directives of the EU regulatory framework, including Directives concerning the integrity and availability of networks, access to emergency services, routing of emergency calls, privacy, security and the lawful interception of communications. It is contemplated that this information and consultation document, as adapted in response to public comments, will be re-issued in the form of (non-binding) guidelines.
