The British Columbia Labour Relations Board has upheld the termination of two unionized workers for posting inappropriate comments on Facebook, the popular social networking site. The comments included references to violence, derogatory comments about other employees, sexual comments and comments critical of their employer.
Though one of the implicated employees was a key union organizer, the employer successfully established that the terminations were not a result of anti-union animus. The Board also held that the employees did not have a serious expectation of privacy in their Facebook account, that they had been dishonest with the employer and that the online comments made were so egregious that termination of their employment was justified.
