A U.S. Federal Appeals Court has ruled that the popular online classified ad service “Craigslist” is not liable as the publisher of discriminatory content posted by its users. U.S. law prohibits landlords from certain forms of discrimination in the leasing of property, and Craigslist users had posted units for rent with restrictions such as “no minorities” in violation of this law. These ads resulted in a lawsuit initiated in 2006 against Craigslist that culminated with the ruling. The appeals court held that because Craigslist was a mere intermediary or messenger, it could not be held liable for the discriminatory conduct. Despite this fact, Craigslist now warns users not to post this type of advertising and asks users to flag them as prohibited.
