Ari David Levie was convicted of two counts of attempting to use a child in a sexual performance and two counts of soliciting a child to engage in sexual conduct. On appeal, he argued that the judge should not have admitted evidence that encryption software was installed on his computer.
The Minnesota appeals court disagreed, ruling that evidence of the existence of an encryption program was relevant to the prosecution's argument that there was criminal intent on the part of the accused.
