Class Action Launched Against Adware Company

An Illinois man has sued adware company 180solutions in an Illinois U.S. District Court alleging that the company deceptively installed software on his computer affecting its performance and forcing him to view unwanted pop-up ads. Plaintiff’s counsel, who specializes in class action matters, has stated that they will seek class certification. Among others, the suit alleges a number of violations of Federal (e.g. privacy and wiretap) and Illinois law (e.g. consumer fraud). 180solutions denies the wrongdoing.

In June of this year, 180solutions took steps to change its image and began displaying messages on PCs to inform users that its software was installed and to give instructions on how to remove it. 180solutions has blamed “rogue distributors” for arranging installations without consent, and exploiting browser security holes to gain access. Earlier this year, N.Y. Attorney General, Eliot Spitzer, sued Intermix Media, a Web marketer, for installing software on PCs without sufficient consent. 180solutions denies any correlation between its actions and the N.Y. suit.
