A class action lawsuit has been filed in Pennsylvania (Case No. G.D. 03-12899) against DoubleClick, Inc., a Delaware corporation that provides products and services to assist direct marketers, online advertisers and publishers in designing, deploying and analyzing marketing campaigns. In the lawsuit, the plaintiffs claim that certain ads served by DoubleClick DART technology use a Fake User Interface (FUI) dialog box resembling legitimate computer system error messages that deceive millions of Internet users to click on them only to be hijacked to the commercial websites of the defendant's customers. Once in these websites, it is claimed that the defendant's customers take control of the unwitting user's computer and attempt to hawk services and software. Finding an easy exit is not simple -'you go close it, and another window opens up'- the plaintiffs claim.
The suit calls for compensatory and punitive damages and seeks an order restraining DoubleClick from engaging further in this alleged "diabolical scheme".
