On February 23, 2005, the Canadian government published the Secure Electronic Signature Regulations under the Personal Information Protection and Electronic Documents Act and the Canada Evidence Act. The regulations are important in that they specify the technologies, processes and requisite steps required to meet the definition of a secure electronic signature in PIPEDA. Furthermore, the regulations provide that a secure electronic signature is trustworthy only if the digital signature certificate is issued by a reliable Certification Authority. Accordingly, the only digital signature certificates that are deemed to be sufficiently trustworthy are those issued by Certification authorities that have been verified by the President of the Treasury Board and who have been listed on the website of the Treasury Board Secretariat.
