On April 10, 2004, a Governor in Council Notice issued and published in the Canada Gazette, pursuant to paragraph 26(2)(b) of the Personal Information Protection and Electronic Documents Act, a proposed exemption order declaring that the current Alberta privacy legislation, Personal Information Protection Act, S.A. 2003, and British Columbia privacy legislation, Personal Information Protection Act, S.B.C. 2003, c. 63, are exempt from PIPEDA.
Accordingly, any future privacy complaints in Alberta and British Columbia that deal with a Provincial undertaking will be handled by their respective Privacy Commissioners. However, any complaints that result from a federal undertaking will continue to be monitored and regulated by the Federal Privacy Commissioner.
On November 19, 2003, the federal government, through Industry Canada, also declared that An Act respecting the protection of personal information in the private sector, R.S.Q., c. P-39.1, of the Province of Quebec is substantially similar to PIPEDA and therefore exempt under the Act.
