BC Supreme Court Finds Election Gag Law Unconstitutional

The British Columbia Supreme Court found Section 329 of the Canada Electronics Act (provision prohibiting the transmission of election results in one electoral district to the public in another electoral district until all polling stations are closed in that district) to be unconstitutional and overturned the conviction of Paul Bryan. Bryan had posted results of the last federal election from Atlantic Canada online before the polls closed in BC. Kelleher J stated that there is no evidence that voters are swayed by seeing early election results from the East.
