Are Software Licenses Unfair

The National Consumer Council in the U.K. has made a complaint to the Office of Fair Trading that lengthy end user license agreements (“EULA”) associated with almost all retail software are unfair, primarily because of the imbalance of rights between the purchaser and manufacturer contained in these agreements. The Council claims that many software products do not display the EULA on the packaging or at the point of purchase, so it is only after buying a product that the consumer is given the opportunity to even read it. The Council has asked for an investigation.
