Apple, maker of the popular iPhone, iPod and iPad, is suing Amazon.com Inc., the largest online retailer in the United States, claiming that Amazon.com is unlawfully using the “App Store” trademark to solicit software developers and to sell software applications for the development of mobile device applications. In a complaint filed by Apple that also cites unfair competition, Apple also alleged that Amazon.com plans to use the trademark with a mobile software download service. Although the U.S. Patent and Trademark Office has approved Apple’s application to register “App Store” as a trademark, the registration is being opposed by Microsoft and will therefore be the subject of proceedings before a trademark appeal board.
