Appeals Court Upholds Decision Barring Regulation of VoIP

In a recent decision, the 8th U.S. Circuit Court of Appeals upheld an earlier ruling of the district court providing that VoIP Internet-based telephone services are not subject to regulation by the Minnesota Public Utilities Commission (MPUC) in the same way that traditional phone services are. Notwithstanding this result, a recent report indicates that the MPUC will also appeal to the 8th U.S. Circuit Court of Appeals to overturn the earlier ruling of the Federal Communications Commission that similarly found in favour of more limited regulation for VoIP Internet-based telephone services in an effort to protect the developing industry.
