Amazon Sales Tax Suit Revived

A New York Appeals Court has reinstated Amazon.com’s lawsuit claiming that a state law forcing it to collect sales taxes is unconstitutional.  The original suits, filed in 2008, concern whether or not out-of-state retailers must charge sales tax on goods shipped to customers in that state.  Amazon has asserted that applying sales taxes to out-of-state Internet and other online business is unconstitutional.

Under New York law, a company without offices or employees in the state must collect sales tax if it receives revenue from affiliates located in the state.
