Adware Company Wins U.S. Summary Judgment Against U-Haul

A U.S. federal court has granted summary judgment to WhenU.com, an adware company that produces pop up ads, against U-Haul in the latter's lawsuit to stop WhenU.com from delivering ads from U-Haul's competitors onto U-Haul's website. This decision will likely influence many other lawsuits filed against the same defendant and other adware companies such as Gator doing similar work. The court's decision with respect to other claims, including one pursuant to the Virginia Business Conspiracy Act , has not yet been released.

"Adware" refers to a software program which is often bundled with free software and results in pop-up and pop-under ads on the screen of the host computer when the user is visiting a specific website. Frequently, the program is set up so that it will be triggered with an ad for a client of the adware company if the user is visiting the website if a competitor of the adware company's client.
