U.S. Supreme Court Refuses to Hear Lexmarks Appeal

The U.S. Supreme Court has refused to hear the appeal of a copyright infringement lawsuit brought by Lexmark, the printer manufacturer, alleging copyright infringement by Static Control Components Inc., a computer-chip maker whose parts allow cheaper toner cartridges to be used in name-brand machines. Using Static Control's chips, it is possible to make cartridges that work with Lexmark's printers but cost less than Lexmark's brand-name cartridges. Previously, the toner cartridges had to be returned to Lexmark for replacement. Meanwhile, Static Control alleged that Lexmark engages in anti-competitive and monopolistic conduct. A federal appeals court in Cincinnati had rejected Lexmark's claim last year and the appeal to the Supreme Court was filed late, and therefore, rejected.
