Rogers Retains Right to Claim Fastest and Most Reliable in Ontario
An injunction sought by BCE Inc.’s Bell Canada (“Bell”) to prevent Rogers Communications Inc. (“Rogers”) from claiming in advertisements that it has the “fastest” and “most reliable” Internet service in Ontario was thwarted by a recent decision by Justice Darla A. Wilson. Wilson J. reasoned that since the ads have been in the marketplace since 2008, and Bell had failed to demonstrate irreparable harm, “there is no justification for the court to interfere in the advertising war between these two large corporations”.
Presently it would appear that Bell will continue with its main action to prevent Rogers from continuing with its claims. However, this latest decision is just the latest saga in what appears to be a cross-country telecommunications advertising battle involving such companies as Bell Mobility, Bell Aliant Regional Communications Income Fund, Vidéotron Ltée, and Telus.
