Privacy Commissioner to Audit Data Flow Between Canada and the U.S.

Canada's Privacy Commissioner, Jennifer Stoddart, has commenced an investigation into the cross-border flow of personal information hastened by the war on terror. The Commissioner's first-ever such audit will concentrate on information about Canadians that is being sent to United States security agencies via the Canadian Border Services Agency ("CBSA"). Stoddart said the audit would help Canadians get a better understanding as to where their personal information is going, how it is being utilized in the U.S. and what safeguards are in place to protect it. In addition, Stoddart feels that the audit will help her to understand the extent of her office's statutory powers and what could be done to improve them. Details are currently being negotiated with officials from the CBSA and the audit is expected to be completed late this year.
