Microsoft Obtains Stay of Injunction Prohibiting Sales of MS Word

The U.S. Appeals Court for the Federal Circuit recently granted Microsoft Corp. a temporary stay of the permanent injunction previously awarded against Microsoft by a U.S. District Court judge in Texas. The injunction prohibited the sale of versions of MS Word that violated the patents of Toronto-based software company i4i. The i4i patents related to the reading of XML (Extensible Markup Language), a data file format which is used in MS Word and other office-productivity applications. In addition to the injunction, which was scheduled to take effect on October 10, 2009, the Texas court awarded i4i damages in the amount of US$290million. Microsoft has appealed the District Court’s ruling of patent infringement on the basis that the i4i patents are invalid.
