The United States Trade Representative has released its 2005 "Special 301" report, which examines the adequacy and effectiveness of intellectual property rights (IPR) protection in 90 countries. The report lists Canada, along with 35 other nations, on the "watch list" of countries meriting attention to address underlying IPR protection problems. The report cites concerns regarding the failure of Canada's proposed copyright legislation reform in the areas of technological protection measures and ISP liability towards protecting copyrighted works in the digital environment, which failures are said to be inconsistent with the WIPO Internet Treaties and out of line with the international standards of most developed countries. The report also urges Canada to implement various measures to improve IPR enforcement, including customs and border measures.
